HERCode — Terms of Service

1) Acceptance of Terms

By creating an account, accessing, or using HERCode's app, website, or services (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2) Eligibility

You must be at least 16 (or the age of digital consent in your country) to use the Service. If you are under 18, you represent you have parental/guardian consent.

3) Accounts & Security

• You're responsible for the accuracy of your information and for keeping your login secure.
• Notify us immediately of any unauthorized use.
• We may suspend or terminate accounts that violate these Terms.

4) The Service (Wellbeing, not Therapy)

HERCode provides self-development and educational content (tests, reflections, exercises, insights).

• We do not diagnose, treat, or prevent any condition.
• If you're in crisis or need professional help, contact licensed professionals or local emergency services.

5) Plans, Trials & Subscriptions

HERCode offers a free tier and a premium subscription.

• Free (Lite): limited access to features and content.
• Premium: expanded and more personalized features.
• Pricing: Subscription prices, currencies, and taxes are displayed in the Apple App Store / Google Play at the time of purchase and may vary by region. The price you see in the store is the price you will be charged.
• Trials & Promotions: From time to time, we may offer a 3-day trial and/or referral bonuses (see §6).
• Billing & Renewal: Subscriptions are billed through Apple App Store or Google Play and auto-renew until cancelled.
• Cancellation: Manage/cancel anytime in your app store settings. Deleting the app does not cancel a subscription.
• Refunds: Handled by your app store under its policies.
• Price Changes: We may change prices for future billing cycles; we'll inform you where required by law or store policy.

6) Referral Program (Invite Friends)

From time to time, we may offer referral rewards (e.g., extra Premium days). By participating, you agree that:

• Eligibility: Only for personal, non-commercial use; one account per person/device (reasonable use).
• How it works: Share your invite link/code. When your friend is a new user and completes the required action (e.g., signs up/starts trial), you may receive the stated reward (e.g., +6 days Premium).
• Limits: Rewards, frequency, and caps (e.g., a maximum number of bonus periods) may apply. Details will be shown in-app at the time of the offer.
• Anti-Abuse: No self-referrals, spam, fake accounts, reselling, or posting to coupon sites. We may decline, revoke, or adjust rewards for suspected abuse or errors.
• Changes: We can modify or end the referral program at any time.

7) User Content & Community Guidelines

You may upload or input content (e.g., journal entries, answers, screenshots) ("User Content"). You retain ownership, but grant HERCode a worldwide, non-exclusive, royalty-free license to host, process, and display User Content solely to operate and improve the Service.

You agree not to upload content that is illegal, abusive, harassing, pornographic, hateful, infringing, or that violates privacy, IP, or platform policies. We may remove content or suspend accounts that breach these Terms.

8) HERCode Content & Intellectual Property

All HERCode content, branding, tests, designs, software, and materials are owned by HERCode or licensed to us and are protected by IP laws. You receive a personal, non-transferable, revocable license to use the Service per these Terms. No rights are granted to copy, modify, reverse engineer, or exploit any part of the Service except as expressly permitted.

9) Acceptable Use

You agree you will not:

• Interfere with or disrupt the Service;
• Access non-public areas, scrape, or use bots without permission;
• Attempt to bypass technical restrictions;
• Use the Service for commercial counseling/therapy or any unlawful purpose.

10) Third-Party Services & Links

The Service may integrate third-party tools (e.g., analytics, cloud hosting, app stores, payment processors). We are not responsible for third-party websites, services, or policies. Your use of app stores is governed by their terms.

11) In-App Purchases (App Store / Google Play)

Purchases are processed by Apple or Google. Their terms, billing, taxes, refunds, and dispute processes apply. Where required by law (e.g., EEA/UK), you may have statutory rights, including withdrawal rights for digital content if applicable—managed by the app store.

12) Disclaimers

The Service is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation, or that insights will meet your goals. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

13) Limitation of Liability

To the maximum extent permitted by law, HERCode and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, goodwill, or business, arising from or related to your use of the Service. Our total liability for any claim will not exceed the amounts you paid to us for the Service in the 12 months prior to the claim (or €50 if greater where required by law).

14) Indemnity

You agree to indemnify and hold harmless HERCode and its affiliates from claims arising out of your User Content, breach of these Terms, or misuse of the Service.

15) Suspension & Termination

We may suspend or terminate your access at any time if we reasonably believe you violated these Terms or used the Service unlawfully. You may stop using the Service at any time. Sections that by nature should survive (e.g., IP, disclaimers, liability, indemnity) will survive termination.

16) Changes to the Service or Terms

We may update the Service and these Terms. If changes are material, we'll provide notice (e.g., in-app or by email) and, where required, obtain your consent. Continued use after changes means you accept the updated Terms.

17) Governing Law & Disputes

These Terms are governed by the laws of Switzerland without regard to conflict-of-laws rules. Courts in Zurich, Switzerland will have exclusive jurisdiction, except where consumer law grants mandatory rights in your country.
